Acknowledgment.
Customer acknowledges agreement with these Terms and Conditions of Sale by the placement of an order to purchase a product from AV Electronics Sdn. Bhd. In addition, by placing an order or purchase, Customer represents that he/she is eighteen years of age or older, that he/she is the same person as named on the credit card used to make the purchase or that he/she has authorization from the credit card owner to use such credit card, and that all information he/she provides is accurate and complete.
Location of Sale.
All sales shall be deemed made in Brunei Darussalam.
Deposits
For Orders: Deposits placed are not refundable or transferrable. Orders cancelled after 2 days are subject to a flat 20% restocking fee. Store credit will be issued as per the amount paid less any restocking fee if applicable.
For hold or reserving: Deposits placed for reserving items are not refundable or transferrable. Items will only be held for two (2) days and will be released for sale thereafter if the sale has not been completed by then. Store credit will be issued as per the amount paid.
For CTO and special orders: AV Electronics strongly encourages you to carefully review orders for goods that are custom-configured to your specifications. Orders for CTO and special order goods cannot be modified or cancelled once submitted. AV Electronics requires full payment in advance for any CTO goods and a non-refundable deposit.
Purchase Price
Prices and promotions are listed in AV Electronics’ website (including Facebook and Twitter), promotional material, brochure and its advertisement, and are subject to change without notice. While we make every effort to ensure the accuracy of information on AV Electronics’ website, promotional material, brochure and its advertisement, errors may occasionally occur. We reserve the right to make corrections to price or other information.
Payment Terms
The price shall be paid by the Customer in on or before the payment date. AV Electronics accepts credit cards and bank loans as the payment options for your purchase. However, these purchases are strictly on normal retail price. Split payment method, while accepted, are also based on normal retail price.
Other payment terms are authorized only by prior agreement from AV Electronics. All cheques should be crossed, printed clearly and made payable to AV ELECTRONICS SDN BHD.
Please insist on a printed official receipt when making payments.
Gift Vouchers
Gift vouchers registered and issued by AV Electronics are recognized as means of payment and must be used within three (3) months of issue and cannot be extended. The Customer must be present and properly identify himself/herself when redeeming his/her gift voucher.
The gift voucher can be used for purchases up to its stated monetary value. For purchases exceeding the value of the gift voucher, the Customer is required to make up the difference between the purchase price and the value of the gift voucher.
The Customer is required to redeem the gift voucher in its entirety on a single purchase receipt/invoice and no change will be given on purchases less than the stated value of the gift voucher. Gift vouchers are not redeemable for cash and cannot be returned for a cash refund. Gift voucher will be forfeited if not used within the aforesaid period.
Store Credit
Store credit issued to the Customer for any reason shall remain valid for a period of one (1) months from date of issue and cannot be extended. The Customer must be present and properly identify himself/herself when redeeming his/her store credit. The Customer is required to redeem the store credit in its entirety on a single purchase receipt/invoice and no change will be given on purchases less than the stated value of the store credit. Store credit will be forfeited if not used within the aforesaid period.
Title of Goods
The goods shall remain the sole and absolute property of AV Electronics as legal and equitable owner and the Customer shall hold such goods as bailee only until such time as the Customer shall have paid the full price. The Customer shall be liable to AV Electronics in respect of any loss or damage to the goods during such bailment.
Return or Exchange of Goods (Exchanges strictly refers to In-Store purchases ONLY.)
AV Electronics will, on best effort basis, assist with product returns within a reasonable time (max 2 days from date of purchase) provided the goods are in original condition, original packaging, current version and not a special order, hardware, peripheral or clearance item. If the return is authorised by AV Electronics, a restocking fee of up to 20% may apply.
Exchanges are offered for In-Store purchases only and are limited to stock on hand. Therefore, you may exchange your purchase for the same item or different product with the same value or request for a store credit. Store credit will be issued as per amount that you paid less restocking fee if applicable.
Please note that where the plastic seal of a software package is broken the return or exchange cannot be accepted due to copyright and licensing restrictions unless faulty nor defective. In this case we will not help the Customer obtain a working copy.
Return or exchange of computer hardware and peripherals is sometimes not possible due to various manufacturers’ constraints on AV Electronics (unless faulty). Many manufacturers have imposed certain return restrictions. Consequently, AV Electronics reserves the right to decline specific return requests based on those restrictions. Unless agreed otherwise prior to purchasing, all sales shall be considered firm sales.
All goods are minutely selected to provide you with the best possible quality. All these first choice goods are in mint condition and carefully checked for defaults by our quality controllers before they are displayed. We highly recommend that you test and inspect the goods carefully before leaving the store.
Promotions
All promotions are subject to availability and inventory. AV Electronics Sdn. Bhd. reserves the right to change, alter, reject or cancel promotions at any time without notice. Promotion items are strictly not returnable or exchangeable.
Limited Manufacturer’s Warranty
The length of the warranty period varies on products. All products are subject to the terms of the warranty that is expressly stated on, packaged with, or accompanies the product unless stated otherwise by AV Electronics and substituted with a localized warranty. Any software that may be included with any product is subject to the license agreement that is part of the software package.
AV Electronics warrants that it has good title to the hardware products it sells, and that it has proper authority to license the software products it distributes.
AV Electronics does not warrant the performance or integrity of any Product, but merely passes through to the Customer whatever end-user warranty the manufacturers or software publishers provide with their respective products.
Limitation of Liability
IN NO EVENT SHALL AV ELECTRONICS BE LIABLE FOR SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFIT OR OPPORTUNITY. CUSTOMER’S SOLE AND EXCLUSIVE REMEDY IS STATED IN THE MANUFACTURER’S OR PUBLISHER’S END USER WARRANTY ACCOMPANYING THE PRODUCT. IN NO EVENT SHALL AV ELECTRONICS’S LIABILITY EXCEED THE REPAIR, REPLACEMENT OR COST OF THE SPECIFIC PRODUCT PURCHASED FROM AV ELECTRONICS.
Exclusive Agreement
These Terms and Conditions of Sale represent the complete and final agreement between the Customer and AV Electronics for the matters set forth herein, and shall be supplemented only by the prices, quantity, and descriptions set forth in AV Electronics’ invoice for the relevant sale. Terms contained in Customers’ purchase orders, offers to buy, terms and conditions, and the like shall have no effect.
General
These Terms and Conditions of Sale and any transactions made under them shall be interpreted by and be subject to the laws of Brunei Darussalam.
In the event any section or portion of a section of these Terms and Conditions of Sale are deemed unlawful or unenforceable, that section or portion of a section shall be stricken from the Terms and Conditions of Sale, and the remaining terms shall continue in full force and effect.
AV Electronics shall not be responsible for damages or delays resulting from Acts of God, and from other actions, both governmental and otherwise, including but not limited to war, terrorism, riot, seizure, and embargo.
AV Electronics may at any time revise these Terms and Conditions of Sale. Pre-Order

Acknowledgment
The customer acknowledges that he/she is placing a pre-order for an item that has not yet been released or launched in Brunei Darussalam and that the customer is subject to the AV Electronics’ terms and conditions for pre-order printed below and AV Electronics’ terms and conditions for sales (available separately) when the sale is completed.
Deposit
Deposits placed are not refundable or transferrable. Orders can be cancelled prior to launch, however orders cancelled after launch may be subject to a flat 20% restocking fee. Store credit will be issued as per the amount paid less any restocking fee if applicable.
Launch Date
If there is no confirmed release or launch date for the item, AV Electronics can only give an estimate of when the item will launch. Neither AV Electronics nor any other Apple authorized retailer or reseller are privy to information from Apple regarding new items until immediately before launch. The customer may cancel his/her pre-order should he/she not wish to wait. Store credit will be issued as per the amount paid.
Price and Specifications
AV Electronics can only give an estimated price for the item prior to its launch. Specifications are based on information provided to AV Electronics at the time of pre-order. Note that prices and/or specifications may change at time of release. The customer’s deposit is to confirm availability of initial stocks to him/her (as per queue order) and not as a confirmation of price and/or specifications.
Limit on Order Quantity
When the demand for a particular pre-order item is considered high, AV Electronics may limit the quantities allowed per customer so as to ensure initial stocks are available to other customers too.
Allocation of Initial Stocks
AV Electronics guarantees that initial stocks of the pre-ordered item will be firstly allocated to pre-order customers and according to their place in the queue. The customer’s place in the queue is defined by when he/she initially paid his/her pre-order deposit.
The customer will be contacted (namely mobile or house number given during his/her pre-order) when his/her order is available. The customer is required to complete the sale by paying the full amount due less his/her initial pre-order deposit within 2 days. If the customer fails to complete the sale within the allocated time, the customer will be deemed to have forfeited his/her place in the queue and AV Electronics reserves the right to offer the item to another customer in the queue.
If the customer cannot be contacted when his/her order is available and he/she has not responded to any message sent (sms, voicemail or email given during his/her pre-order) informing him/her of the order’s availability, then he/she will be deemed to have forfeited his/her place in the queue and AV Electronics reserves the right to offer the item to another customer in the queue.
The customer who has forfeited his/her place in the queue for the above reasons will be placed into the post-launch customer queue.
General

Quotation

Acknowledgment
The Customer’s offer resulting from AV Electronics’ quotation is expressly conditioned upon customer’s assent to AV Electronics’ terms and conditions for quotations printed below and AV Electronics’ terms and conditions for sales (available separately) when the sale is completed.
Acceptance
All purchase orders and/or contracts are subject to acceptance by AV Electronics Sdn. Bhd.
Prices, specifications and terms
The prices, specifications and terms on the quotation are not subject to verbal changes or other agreements unless approved in writing by an authorised representative of AV Electronics. All quotations and agreements are contingent upon strikes, accidents, fires, availability of materials and all other causes beyond our control.
Validity of Quotation
Prices are based on costs and conditions existing on the date of quotation and are subject to change by AV Electronics based upon market conditions after expiration of the quote valid date. If no such date is provided, the quote shall expire five business days after the date of the quote.
Quotations based on promotional pricing shall only be valid within the period of the promotion and shall expire once the promotion ends. Any financing or leasing contracts with the customer’s bank must be in order and the purchase based on the aforesaid quotation must be completed before the end of the promotion.
Availability of Item
If there is a product that is no longer available, the product will then be replaced or substituted based on customer’s request and is subject to their final approval.
Non-Stocked Items
Price on non-stocked products are subjected to price and stock fluctuations and can only be confirmed once the quote is turned into an order. While we endeavour to honor every prices quoted, if there is a price increase that is beyond our control, we reserve the right to increase the price as necessary.
General

Service and Repair

Acknowledgment
Please note that the customer with his/her signature is affirming the requirement of service to the problem as reported. By signing the Service Request Order (SRO) document, he/she is confirming on the unit condition and eventual completeness of the work done upon checkout.
AV Electronics accepts the unit/s, with the understanding that they will undertake, whatever repairs and replacement of defective parts are necessary and charge for this at AV Electronics’ regular price if applicable.
Warranty Claim
Warranty repair must be claimed at the time when the equipment is returned for repair. Returning a unit during the warranty period does not automatically mean that it will be repaired free of charge. Upon receiving the customer’s unit, the validity of warranty will be checked against AV Electronics’ database and the unit will be inspected to ensure that it conforms to the terms and conditions as stated on the respective unit’s warranty.
AV Electronics will honour warranties of Apple products bought from other vendors, however the customer must also produce proof or purchase for their unit. Further information, please contact us.
Non- Apple branded accessories and peripherals warranty coverage :
This limited warranty does not cover misuse, unauthorized modifications, and external causes such as acts of nature. This warranty does not cover normal wear and tear, or damage to any other product used in connection with this product. This Warranty does not apply to damage caused by accident, abuse, misuse or modification of the Product. This warranty excludes without limitation any scratching or surface damage to any other product, even if packaged with or sold with the Product.

Receipt
The receipt must be produced when claiming unit/s. In case of loss of the receipt, AV Electronics reserves the right to refuse delivery until AV Electronics can establish the identity of the customer. It is the responsibility of the customer to check that all accessories are returned.
Customer’s Data and Settings
All customer’s settings, internal memory data may be lost due to repair. AV Electronics is NOT responsible for any data loss associated with a repair (even though we endeavour to preserve any data). We strongly advise that data is backed up to an external device before sending unit/s in for service. For further information, Data Back Up Disclaimer.
Out of Warranty Work
The customer’s unit will be assessed and he/she will be quoted the price of the replacement parts as required for the repair. Full payment for replacement parts will be required before the said parts are ordered, if the customer’s unit is out of warranty. The unit will not be released until all charges are fully paid as per invoiced.
Return of Items Unrepaired
AV Electronics reserves the right to return unrepaired, such unit/s which, after inspection are found to be unserviceable due to unavailability of parts, rejected after quotation is made or such other reason which does not enable the unit/s to be repaired. We do not guarantee those unrepaired items can be restored to the original appearance or functions as before. Inspection fee is applicable and payable before release of the item to the customer.
AV Electronics reserves the right to return such unit which quotation has been made after inspection but refused to repair or not confirmed for more than one month. Inspection fee is applicable and payable before release of the item to the customer.
Loss or Damage and Abandonment
AV Electronics is not responsible for any loss or damage due to contingencies beyond their control or if units are not claimed within three months of date of the receipt.
Unit/s remaining unclaimed six months from the date of the receipt will be deemed forfeited and may be disposed of at the discretion of AV Electronics without prior notice and/or compensation to customer.
Guarantee of Repair
AV Electronics will undertake, free of charge, any further adjustment or repair necessary if the first repair was not completed satisfactorily, provided the unit is returned within one month from the date of collection. This excludes cleaning and additional charges of parts, which may be required.
AV Electronics will warrant the replacement parts (hardware) for 3 months from the date of release of the item to the customer.
AV Electronics does not provide warranty for the proper operation of software installed on the customer’s behalf including operating systems installed onto new/replacement hard drives.
Software Installation
If repair service involves transferring information or installing software, the customer represents that he/she have the legal right to copy the information and agree to the terms of the software license, and he/she authorizes AV Electronics to transfer the information and accept such terms on his/her behalf in performing the service.
Return of Parts Replaced
All part/s replaced are not returnable.
Out of warranty iPods sent for battery replacement and eligible for the Apple Battery Replacement Program will be exchanged with a replacement iPod pre-installed with a new battery. The original iPod will be returned to Apple for recycling.
Data Backup Disclaimer
The following terms of service (“TOS”) will apply to the agreement to provide service between AV Electronics (“Company”), and the individual or business entity identified on the order form for said services (“Customer”). These terms shall hereinafter be referred to as the “Agreement” between the two above mentioned parties.
i) AV Electronics Sdn. Bhd. it’s employees, agents, and representatives grant unlimited permission to copy/image/backup all data present on customer computer for the purpose of performing repair services on the computer.
ii) AV Electronics Sdn. Bhd. may create a complete “Image” of customer computer’s data in order to attempt to restore or back up the system to its original state in circumstances where AV Electronics Sdn. Bhd. may deem appropriate.
iii) AV Electronics Sdn. Bhd. may, at it’s discretion, make backup copies of customer data in order to perform repair services to the computer.
iv) AV Electronics Sdn. Bhd. may retain copies of customer computer’s data, as described above, for a period of (3) three days, commencing on date of Service Repair Order.
v) AV Electronics Sdn. Bhd. or any of its employees, agents or representatives liable, will not hold responsible in any way, for the loss, use, alteration, or corruption of this data. After the period of time specified above, AV Electronics Sdn. Bhd. will destroy all copies of the data specified above, through means which it deems to be satisfactory. Services rendered are provided on a non-refundable basis.
